GENERAL CONDITIONS OF SALE

  1. Acceptance of the general conditions of sale and conclusion of the contract

1.1 The contract entered into between Hènope di Sinergy Srl and the Customer (i.e., the natural person who makes a purchase on the Website for purposes not related to their own commercial, entrepreneurial or professional activity) shall be deemed to be concluded with the acceptance of the order by Hènope di Sinergy Srl, even on a partial basis. In case of non-acceptance of the order, the latter shall notify the Customer in a timely manner.

1.2 By placing an order using one of the available methods, according to the order form on the Website (hereinafter the "Order"), the Customer declares that they have read all the information provided during the purchase process and that they fully accept these general conditions (hereinafter the "Conditions").

1.3 These Conditions may be printed or stored on a durable medium, subject to the provisions of article 12 of Legislative Decree no. 70/2003 and article 51 of Legislative Decree no. 206/2005, as amended by Legislative Decree no. 21/2014.

1.4 Hènope di Sinergy Srl shall refund the Customer for the full amount paid, net of shipping costs incurred and any customs duties paid for imports, within 14 days of the date of cancellation, transferring the amount charged using the same payment method used by the Customer for the initial transaction, unless agreed otherwise. In any case, the Customer will not incur any costs as a result of the refund. Hènope di Sinergy Srl may withhold the refund until the returned product is received.

  1. Purchase methods

2.1 The products offered for sale by Hènope di Sinergy Srl are exclusively those available on the Hènope di Sinergy Srl Website at the time the Order is placed, as described in the relevant information sheets.

2.2 In any case, it is understood that the images accompanying the product descriptions are for information purposes only and may not be perfectly representative of their characteristics but may differ, for example, in terms of colour and size (and due to the browser and monitor used to access the Website and view the images).

2.3 In order to place an Order, the Customer must fill out the relevant form on the Website in its entirety and send it after carefully reviewing the Conditions, as well as the characteristics of the product(s) they intend to purchase. The Customer can also request, if they so wish, the issuance of a tax invoice for the purchase from Hènope di Sinergy Srl, pursuant to article 22 of Presidential Decree no. 633/1972.

2.4 The correct receipt of an Order is confirmed by Hènope di Sinergy Srl by means of an email reply sent to the email address provided by the Customer. This confirmation message will summarise the conditions of purchase, as required by applicable law, as well as the data entered in the Order by the Customer, so that the latter can verify it and communicate without delay the necessary corrections to any incorrect data.

As of 28 December 2020, online payments have become even more secure thanks to the new European PSD2 legislation that introduces new anti-fraud rules.

Now, when you place an order online and use your card as the payment method, your bank may ask you to confirm your identity using 3-D Secure authentication.

What is 3-D Secure authentication for and how does it work?
3-D Secure authentication reduces the amount of fraudulent activity online, including identity theft and unauthorised card use. It protects cardholder data and reduces fraud attempts.
There are several ways to authenticate online payments, and the one you use will depend on the method your bank has decided to adopt. You may be asked to confirm your identity via text message, email or TouchID on your smartphone.
We recommend that you contact your bank to ensure that they have your correct contact details in case you are required to use SMS or email for 3-D Secure authentication.

3.1 The prices shown on the Website are inclusive of taxes and VAT. Any shipping costs or payment fees will, in any case, be communicated to the Customer in advance by way of the Website or these Conditions.

Card

For purchases made using card as the payment method, the transactions can be made using the Paypal secure server or another secure server chosen by Hènope di Sinergy Srl.

In no case and at no stage of the payment shall Hènope di Sinergy Srl be able to know the Customer's card information, which is transmitted via secure connection directly to the website of the bank handling the transaction. Such data will not be stored as computer files by Hènope di Sinergy Srl, and therefore under no circumstances shall Hènope di Sinergy Srl be held responsible for any fraudulent or illegal card use by third parties at the time of payment.

    1. Product delivery

The purchased products will be delivered by Hènope to the address indicated by the Customer in the Order within 24/48 hours of the acceptance of the Order within Italy, 48/72 hours in the European Union member countries, and 3/6 days in the rest of the world.

At the time of delivery of the products, the Customer is required to check that the packaging is intact, undamaged, and is not wet or otherwise altered.

Any damage to the packaging and/or the product or a mismatch in the number of packages or information must be reported immediately by putting a specific note on the delivery document of the product to be returned to the courier. 

Any problems regarding the physical integrity, correspondence or completeness of the products received must be reported within 48 hours of delivery.

  1. Right of withdrawal

5.1 Pursuant to article 52 of Legislative Decree no. 206/2005, as amended by Legislative Decree no. 21/2014, the Customer may withdraw from the Conditions and therefore from the purchase contract for any reason, without the need to provide a reason and without penalty, within 30 (thirty) working days of the date of receipt of the products.

5.2 In order to exercise the right of withdrawal mentioned in article 5.1, the Customer must send Hènope di Sinergy Srl a communication to that effect, within the terms indicated; this communication must be sent via registered letter with return receipt, addressed to:

5.3 In case of withdrawal, the Customer will have to return the products to Hènope di Sinergy Srl at their own expense within 30 (thirty) days of the actual withdrawal:

The goods must be returned intact, complete with all their parts and in the original packaging (envelopes and boxes), having been kept and possibly used only for the amount of time strictly necessary to establish and verify their nature, characteristics and size, according to due diligence, without any signs of wear or dirt, in accordance with the conditions below:

  • The right of withdrawal applies to the products purchased in their entirety; it is not possible to exercise the right of withdrawal for part of a product purchased (e.g., accessories, etc.);
  • for the withdrawal to be possible, the products must be intact and returned in their original packaging, complete with all its parts (including packing materials and any documentation and accessories: labels, tags, seals, etc.);
  • shipping costs (and customs fees, if any) for the return of the goods will be borne exclusively by the Customer;
  • the shipping process remains the full responsibility of the Customer until receipt is confirmed in the warehouse indicated by Hènope di Sinergy Srl;
  • in case of damage to the goods during transport, Hènope di Sinergy Srl will inform the Customer in order to allow them to file a timely complaint against their chosen courier and obtain the appropriate refund; the product will then be made available to the Customer, thereby cancelling the request for withdrawal;
  • Hènope di Sinergy Srl will not be held responsible in any way for any damage, theft or loss that occurs during or is in any case caused by the return shipping process.

5.4 Hènope di Sinergy Srl shall refund the Customer the full amount already paid, net of any additional shipping costs, pursuant to article 56, paragraph 2, of Legislative Decree no. 21/14), within 14 days of the withdrawal, by way of a transfer of the amount charged using the same payment method used by the Customer for the initial transaction, unless agreed otherwise. In any case, the Customer will not incur any costs as a result of the refund. Hènope di Sinergy Srl may suspend the refund until receipt of the returned product or until the Customer demonstrates that they have correctly returned the product, if earlier.

5.5 In any case, the Customer will forfeit their right of withdrawal in cases where Hènope di Sinergy Srl ascertains that:

  • the returned product and/or its accessories and/or its packaging are not intact;
  • the product is missing its original external packaging and/or internal packaging;
  • the product is missing integral parts of the product itself and/or its accessories (e.g., fasteners, laces, buckles, etc.).

In the case of forfeiture of the right of withdrawal, Hènope di Sinergy Srl shall return the purchased product to the sender, charging the latter for the shipping costs and, if already refunded, the price of the product.

5.6 The right of withdrawal is not applicable in the following cases:

(a) service contracts, after the service has been fully performed, if said performance began with the consumer's express agreement and acceptance that they will lose their right of withdrawal following the full performance of the contract by the professional;

(b) the provision of custom or clearly personalised goods;

c) The right of withdrawal is only practicable for private individuals, and not in any case for companies or VAT ID holders who purchase using this billing arrangement. The only valid billing information is that entered in the order. This billing information will no longer be editable by the customer at a later date.

  1. Warranties

6.1 All products sold by Hènope di Sinergy Srl are covered by a 24 (twenty-four) month warranty for conformity issues, pursuant to Title III of Legislative Decree no. 206/2005. To benefit from the warranty service, the Customer must keep their invoice.

6.2 The warranty for conformity issues shall apply provided that the product in question has been used correctly, in compliance with its intended use and the instructions for use and washing provided in and/or with the product.

6.3 In the event that, for any reason, Hènope di Sinergy Srl is not able to return a product under warranty to the Customer (repaired or replaced), or where the repair or replacement proves excessively expensive, including due to the value of the product, Hènope di Sinergy Srl may offer an appropriate reduction of the price paid, or refund the entire amount paid and terminate the contract. 

6.4 In cases where the application of the warranty requires the return of the product, the latter must be returned by the Customer in its original packaging, complete with all its parts (including packing materials and any documentation and accessories).

8.1 The personal data collected by placing the Order shall be processed by Hènope di Sinergy Srl for the sole purpose of satisfying the Customer's express requests, in accordance with EU Regulation 2016/679 and the privacy policy on the Website. Any further processing will be carried out only with the express consent of the Customer.

  1. Applicable law

9.1 The contract of sale referred to in these Conditions and its execution is governed by Italian law, disapplying the conflict rules and the United Nations Convention on Contracts for the International Sale of Goods. The court of the Customer's town of residence will have jurisdiction for the resolution of any disputes.
